1. Acceptance of Terms

By accessing or using any website, platform, or service operated by Blyxxa LLC ("Blyxxa," "we," "our"), including blyxxa.com and blyxxa.online, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must discontinue use immediately.

2. Our Services

Blyxxa provides digital technology services including, but not limited to:

  • Custom web development and corporate web solutions
  • Industry-specific software and SaaS platform development
  • AI integrations and intelligent automation systems
  • GEO and advanced SEO consulting
  • Digital kits, templates, and smart content tools
  • Brand strategy and digital consulting

The scope, deliverables, timeline, and pricing for custom services are defined in separate project agreements or proposals between Blyxxa and the client.

3. Intellectual Property

3.1 Our Content

All content on our websites — including text, graphics, logos, icons, images, code, and digital products — is the intellectual property of Blyxxa LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission.

3.2 Client Deliverables

For custom development projects, ownership of deliverables is defined in the respective project agreement. Generally, upon full payment, clients receive ownership of the custom code and assets created specifically for their project. Blyxxa retains the right to reuse general methodologies, frameworks, and non-client-specific components.

3.3 Digital Products

Purchased digital products (kits, templates, guides) are licensed for personal or business use by the purchaser. Redistribution, resale, or sharing of purchased products is strictly prohibited unless explicitly stated in the product's license terms.

4. User Obligations

When using our services, you agree to:

  • Provide accurate and truthful information in all communications and transactions.
  • Use our services only for lawful purposes and in compliance with applicable laws.
  • Not attempt to gain unauthorized access to our systems, accounts, or data.
  • Not use automated scripts, bots, or scraping tools on our websites without permission.
  • Not interfere with or disrupt the integrity or performance of our services.
  • Respect the intellectual property rights of Blyxxa and third parties.

5. Payment Terms

  • Digital Products: All purchases made through our platforms (Gumroad, Payhip) are final upon delivery. Refund policies are outlined in our Refund & Purchase Policy.
  • Custom Services: Payment terms for consulting and development projects are specified in individual project proposals. Typically, a deposit is required before work begins, with remaining payments tied to project milestones.
  • Currency: All prices are quoted in USD unless stated otherwise.

6. Limitation of Liability

To the maximum extent permitted by law, Blyxxa LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

  • Your use of or inability to use our services or digital products.
  • Any unauthorized access to or alteration of your data or transmissions.
  • Any third-party conduct or content accessed through our platforms.
  • Any errors, bugs, or inaccuracies in content or services.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Blyxxa in the 12 months preceding the claim.

7. Disclaimer of Warranties

Our services and digital products are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or completely secure. See our full Disclaimer for more details.

8. Indemnification

You agree to indemnify and hold harmless Blyxxa LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, misuse of our services, or infringement of any third-party rights.

9. Termination

We reserve the right to suspend or terminate your access to our services at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts located in Bernalillo County, New Mexico.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of our services after changes constitutes acceptance of the modified Terms.
